Customer (“you” and “your”) and AR Bespoke Jewellers (“we”, “our” and “us”)
USING OUR WEBSITE AND SECURITY
By accessing and using our website at www.arbespokejewellers.com you are agreeing to be automatically bound by the current Terms and Conditions of use including any relevant laws of England and Wales.
PRIVACY POLICY AND DATA PROTECTION
In relation to personal data, we will:
Process it fairly, lawfully and in a clear, transparent way;
Collect personal data only for specific and legitimate reasons;
Only use it in the way that we have told you about;
Ensure it is correct and up to date;
Keep your data for only as long as we require it;
Process it in a way designed to ensure it will not be lost, destroyed or used for anything that you are not aware of.
USER CONDUCT OF WEBSITE
You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through our website.
ENTERING INTO A CONTRACT WITH US
A contract between you and AR Bespoke Jewellers will only exist for a sale of our items once you pay for and submit your order and until we receive notification via email. We will notify you by email when we have dispatched your order. Acceptance of the order will be deemed both complete and to have been effectively communicated to you when AR Bespoke Jewellers sends the order acknowledgement email to you (whether or not you receive that email).
ITEM PRICES
All prices for AR Bespoke Jewellers’s items will be as stipulated at the time of you placing an order via email. We are entitled to amend the price to account for an increase in our supplier’s prices, or the imposition of new taxes or duties, or if due to an error or omission, the price for one of our items is found to be incorrect.
ITEM SPECIFICATIONS
Some of the items may vary in colour/style. Therefore, whilst we will include as much details as possible for our item descriptions, it may not be reasonably possible to keep specifications completely up to date. All descriptive matters, pictures, colours, specifications and advertising on the website are for the sole purpose of giving an approximate description of the items to the best of our ability and knowledge.
PAYMENT PROCESSING SERVICE
AR Bespoke Jewellers’ website is powered by Stripe to provide a secure, robust and reliable payment processing service. We accept debit and credit card payments from Visa, Mastercard, American Express, Stripe and payments using PayPal. We recommend that you read over our PRIVACY POLICY concerning processing of payments and the steps we take to ensure it is secure and safe.
DISPATCH AND DELIVERY PROCESS
We aim to dispatch jewellery items within 2-6 weeks of placing your order, depend on bespoke order (see exception below).
While we send you an estimated delivery date/time upon processing your order, we cannot guarantee a specific arrival date, as it all depends on the item/s ordered and delivery timescales, including potential delays with Royal Mail or our couriers, which is outside of our control.
If you require your order before 4 weeks, we strongly recommend that you email us at enquiries@arbespokejewellers.co.uk before placing your order online, in order for us to check if we can accommodate your request. We do our very best to meet our customer requests but cannot guarantee an expedited order dispatch date for all Customers. It will depend on item availability, business needs and resources at the said time.
Bespoke order this will take between 4 – 6 weeks to create the order and dispatch, being a custom item. Please email us to discuss this for further information. We offer free UK shipping. Both are fully insured “door to door”. You will also be able to track the shipping of your order online and will be provided with those details by us.
On the date of delivery, you will need to sign for the delivery on receipt, after which time the item/s become your sole responsibility.
We will not be responsible for any losses, costs, damages or charges that you may suffer in the event we have had to delay the dispatching, delivering and/or supplying of our item/s where it was outside of our control and/or the responsibility of Royal Mail or our courier. This will not affect your insurance rights for the dispatched item/s.
RETURNS POLICY
IF YOU ARE UNHAPPY
Bespoke orders are not refundable unless there is a fault which was not caused by misuse, an accident, normal wear and tear or by not following the care instructions
Contact the AR Bespoke Jewellers’ straight away and report the problem. Return instruction will be provided to you including, the packaging (if possible) and any proof of purchase with you. If you can take a photograph of the item showing the problem or fault, this is advisable.
If a minor fault was present, but you have worn the item a few times, it is reasonable to accept a repair. This won’t stop you claiming a replacement or refund if the repair turns out to be unsatisfactory. A Jewellery repair should be carried out within a reasonable period of time and without causing you significant inconvenience. Any Jewellery repair should restore the item to a satisfactory condition. If this does not happen, you can argue for a replacement or compensation, in the form of a sum of money or the cost of repairing the item. If the item cannot be replaced or repaired economically, you can argue for a refund. If you are unable to reach a mutually agreed conclusion, you can also contact us to make a complaint enquiries@arbespokejewellers.co.uk.
You will be responsible for the costs of returning the item to us, preferably by registered/special delivery, in case it gets lost or delayed in transit. We strongly advise that you obtain proof of posting and use recorded/special delivery using Royal Mail, DHL or FedEx. We will not be liable if the returned items are delayed and/or lost in transit. We will only be liable from the date of receipt of the returned order.
ENGAGEMENT RING WARRANTY
All of our engagement rings come with a lifetime warranty and if any of the small stones fall out of the setting we will be happy to replace or fix your engagement ring for you at no cost other than the return postage fee.
However, the warranty does not cover the following circumstances*:
• Loss of your engagement ring and/or
• If you lose the centre diamond/gemstone from the engagement ring.
• Any alteration done by any other jeweller/third party.
*We strongly suggest that you insure your engagement ring to cover the above exclusions.
ITEMS EXCLUDED FROM OUR REFUND/EXCHANGE POLICY
The below items are strictly excluded:
• Engraved items. This is unless the item is found to be faulty when created or manufactured and we will rectify this without any charge. You will still be required to follow our returns process above and will be responsible for payment of return postage.
• Items that have been personalised or customised (all bespoke orders or made on request), as these have been made in accordance with your specific requirements.
• Rings that have previously been resized by us or any third party.
This does not affect your statutory rights.
ADVERTISING AND PROMOTIONS
We reserve the right to place advertisements and promotions on the website. Advertisers and sponsors on our website, if any, must comply with all local, national, state and international laws (where relevant) and are solely liable for their actions.
DISCLAIMER
AR Bespoke Jewellers makes no warranties, may it be expressed or implied, therefore negates all other warranties.The information on our website is for information purposes only and, although we have made every effort to ensure the correctness of the information, the said information is provided as stated/specified/displayed and without warranties or conditions of any kind whether express or implied.
Furthermore, we do not make any representations concerning the accuracy or reliability of the information on our website or otherwise and/or any sites linked to our website.
LIMITATION OF LIABILITY
To the fullest extent allowed by the law, under no circumstances, including, but not limited to, negligence, are we liable to the Customer/Recipient for any direct, indirect, incidental, special or consequential damages that result from the use of and/or the inability to use the information on our website, any changes to the website, data sent or received or not sent and/or for any of the above mentioned damages that result from the use or inability to use our products.
This does not impact your statutory rights.
PERFORMANCE OF CONTRACT AND LEGAL JURISDICTION
We shall not be liable for any failure to perform our obligations as a result of circumstances that are beyond our reasonable control. This includes but is not limited to a ‘force majeure’ incident. Any such failure to exercise or enforce a right or provision of the terms of use will not constitute a waiver of such right or provision unless we (the Customer and us) have both acknowledged and agreed this in writing.
The terms of use are governed by and construed fully in accordance with the laws of England and Wales. Both parties agree to submit to the exclusive jurisdiction of the courts located in England and Wales. If any provision of the terms of use is held by a court of jurisdiction to be contrary to law, then such provision will be construed to reflect the intentions of the parties with the other provisions that are in full force and effect.
AMENDING TERMS AND CONDITIONS
We reserve the right to change the terms or any of the policies regarding the use of the website, our items and/or services (including item descriptions, prices or and/or item availability) at any time and may notify you by the act itself of posting an updated version of our terms and conditions on our website.
The information on our website may include technical, typographical, or photographic errors and we cannot promise all the materials are completely accurate. AR Bespoke Jewellers may need to change the content or information, at any time, without giving prior notice.
REFERENCE TO OTHER SITES ON OUR WEBSITE
AR Bespoke Jewellers is not responsible for content including its accuracy of websites that are linked to our own website page. The presence of any link does not imply endorsement by AR Bespoke Jewellers of our site or information. The use of any linked website is at the Customer’s own risk so we always suggest to act carefully.
